Terms and Conditions

for the use of the "I am OK" app

1. Scope

These Terms and Conditions (T&Cs) govern the use of the "I am OK" app between the operator abuda GmbH, Lindenweg 1, 2572 Möringen, and the users (seniors and assistants). By installing and using the app, you accept these T&Cs.

2. Service Description

"I am OK" enables secure and easy communication between seniors and their relatives, friends, or assistants. With just one tap, seniors can send a daily status signal within a specified time window. If no signal is sent, all assigned assistants automatically receive a push notification.

Features:

  • Unlimited connections between seniors and their assistants.
  • Push notifications for reminders and alerts.
  • Support for 11 European languages.
  • Personal data is stored exclusively locally on the respective device.
  • The app is free for seniors. Assistants pay a small, recurring annual fee. The subscription can be canceled at any time.

3. Registration and Use

The app is available for Android and iOS devices. Installation is required on both seniors' and assistants' devices. The connection is established via a secure code generated on the senior's device. Language and time window can be individually adjusted at any time.

4. User Obligations

The app does not replace emergency calls or professional medical assistance.

5. Prices and Payment

Free for seniors. Assistants pay an annual service fee as indicated in the app store. There are no hidden costs.

6. Data Protection

All personal data is stored exclusively locally on the users' devices and is not shared with the provider or third parties. For more information, please refer to the separate privacy policy.

7. Availability

The provider strives to ensure uninterrupted availability of the app but cannot guarantee it at all times. Technical or personal reasons may prevent the transmission or receipt of status messages.

8. Termination and Deletion

Users can delete their account at any time. All data will be permanently removed. The subscription can be canceled at any time. Assistants and seniors will be notified via push notification about the disconnection.

9. Liability

The provider assumes no liability for damages caused by missing or delayed status messages. The app does not replace personal care or medical supervision. Liability for technical failures is excluded, except in cases of intentional or gross negligence.

10. Changes

The provider reserves the right to change these T&Cs at any time. Users will be informed of changes. Continued use of the app constitutes acceptance of the modified terms.

11. Final Provisions

Only Swiss law applies, including the cantonal provisions of the Canton of Bern. Should individual provisions of these T&Cs be invalid, the remaining provisions shall remain valid.
